Update on KIP aka Union Bay Estates application to discharge treated sewage into Hart Creek

Received this email from an individual (name removed) regarding the proposed application. This is a follow up on this post: https://allthingsunionbay.com/2019/11/26/kip-aka-union-bay-estates-plans-on-discharging-1875-meter-cubes-treated-sewage-daily-to-hart-creek-is-more-than-the-new-reservoir-holds/

Public Health Act SEWERAGE SYSTEM REGULATION http://www.bclaws.ca/EPLibraries/bclaws_new/document/ID/freeside/22_326_2004 “(2)Despite subsection (1), a person may discharge domestic sewage or effluent into waters as described in section 2.1 (1) (a) if authorized under another enactment.” Is KIP authorized under another enactment to discharge treated sewage into Hart Creek? A salmon bearing creek?

Hello MXXXXXX,

Thank you for your enquiry, Russell Dyson has requested that I respond on his behalf.

The CVRD is aware that Union Bay Estates is proceeding with an application for registration under the Municipal Wastewater Regulation (MWR) for a seasonal discharge of treated effluent to Hart Creek.

The discharge of treated effluent to the environment is regulated by the Province of British Columbia under the MWR. The MWR registration process does not provide opportunity for regional district input however, First Nations referral is required as noted in the response below.

The CVRD is currently reviewing the developers proposed method of treatment and discharge for compliance with the Master Development Agreement. The MDA and information on current site activities can be found on our website at the following link: www.comoxvalleyrd.ca/projects-initiatives/past-current-projects/union-bay-estates (also provided below).

Hello,

Please find the attached letter for your information. This letter prompts two questions??

1} Was the CVRD aware of this application to deposit 1875 cubic meters of treated municipal sewage per day into Hart Creek in Union Bay ??

2} Will the CVRD support this application??

Sincerely

XXXXXXXXXX

Update on Kensington Island Properties aka Union Bay Estates “Deficient” Sewage Application

Continuation from this post: https://allthingsunionbay.com/2021/08/26/update-on-kensington-island-properties-aka-union-bay-estates-deficient-sewage-application/

This image was posted on Facebook stating it is a lift station for the new development. Funny, the guy posting the picture turned off comments about this and yet allows a free for all and joins in when discussing people he views as a POS (piece of shit). When it comes to the developer, no one wants to hear concerns and wants to keep things positive. The gloves are off though for people they deem beneath them. Obviously, the new Sheriff and provider of information to visitors regarding the development, isn’t aware of the sewer application glitch. Details, who cares about details?

Where is it going to lift to, since the application started Feb. 2018 was determined to be ‘deficient’ and the developer must submit a complete final application. This was probably ordered a long time ago, prior to the application being found ‘deficient’.

As of today the application is still “Pending Customer”.

If you want information on the lift station locations and other diagrams, this is a link to a pdf, included in an FOI request, titled “UBE sanitary master plan review draft” Sept.2019 MOE2020 https://drive.google.com/file/d/1-doHM7f6O-TWwbwtj5HwnbJtl3CgbsqQ/view?usp=sharing Here is one of the diagrams. The resolution is poor, but able to read the legend on the diagram.

Update on Kensington Island Properties aka Union Bay Estates “deficient” Sewage Application

This is a follow up to these posts: https://allthingsunionbay.com/?s=kip+sewage+application

...the application was found to be deficient.”

Who’s surprised this developer’s application would be deficient? Been hiding from the landowners for years now. So the application has been sent back with the applicant expected to submit a complete final application. Appears the developer hasn’t advised when the final application package will be submitted. How is the developer going to build homes without sewage?

1875 cubic metres of treated sewage dumped into Hart/Washer Creek daily except for summer months. Notice KIP’s pipe collecting data in the deepest part where the creek narrows under the trestle.

Video from July 31, 2021. The area under the trestle is like a bowl with rocks higher before and after the trestle. Is the data from KIP’s pipe skewed to indicate higher levels of flow due to the location?

KIP started the application around March 2018 and the review process in Nov. 2019. Here’s a huge FOI with all the info: https://drive.google.com/file/d/1-Mr7745Th_nxH62pD-KiCEjwhbdeG1ln/view?usp=sharing

Picture below taken a couple of days ago. Kip’s pipe is in the deepest part – notice how high the rocks are on the right. The creek has brought down a lot of rock over the winter and is more shallow.

Close up of Kip’s pipe gathering information to support dumping 1875 cubic metres of treated sewage daily into this small creek.

Latest Update on Kensington Island Properties aka Union Bay Estates Sewage Application to Dump Treated Sewage Into Hart/Washer Creek

Here’s previous posts regarding KIP’s intention to dump treated sewage into Hart/Washer Creek for the exclusive use of the development until a regional system we will pay for so the developer can hook into. Remember the MDA states the developer would provide a system that Union Bay and Royston could hook into – now it’s assbackwards. https://allthingsunionbay.com/?s=KIP+sewage

Thanks to a fellow landowner who sent me this voicemail from earlier this month regarding KIP’s sewage application. Voice is Melanie Mamoser, who is handling the application.

The Homer gif is added due to the fact you can’t upload just audio to Youtube.

KIP not approved yet for the larger system which would be the dumping of 1875 Cubic metres of treated sewage daily into Hart/Washer Creek. KIP has approval for a ‘holding tank’ for the Discovery Centre.

KIP still hasn’t paid the fees for the building permit for the Discovery Centre, hasn’t turned over the 6 affordable housing lots, and hasn’t turned over the Parks and Trails.

Previous email from Mamoser.
