What criteria is used to approve the developer to use a specific area of the over 700 acres of land as a gravel pit?

Does the CVRD have a say in the location of the Gravel/Sand pit?

Does Kensington Island Properties sewage application to dump treated sewage into Hart/Washer Creek meet the conditions in the MDA?

Latest Update on Kensington Island Properties aka Union Bay Estates Sewage Application to Dump Treated Sewage Into Hart/Washer Creek

Here’s previous posts regarding KIP’s intention to dump treated sewage into Hart/Washer Creek for the exclusive use of the development until a regional system we will pay for so the developer can hook into. Thanks to a fellow landowner who sent me this voicemail from earlier this month regarding KIP’s sewage application. Voice is Melanie Mamoser, who is handling the application.

KIP not approved yet for the larger system which would be the dumping of 1875 Cubic metres of treated sewage daily into Hart/Washer Creek. KIP has approval for a ‘holding tank’ for the Discovery Centre.

KIP still hasn’t paid the fees for the building permit for the Discovery Centre, hasn’t turned over the 6 affordable housing lots, and hasn’t turned over the Parks and Trails.

Union Bay Estates aka Kensington Island Properties Sewage Application – MOE Aware of MDA Requirements.

Why is KIP proceeding with this application knowing it does not comply with the MDA? Because that’s what this developer does – never happy with any agreement, always wanting to change the conditions previously agreed to. That’s why nothing ever materialized all these years except constant whining about how it was everyone else preventing the development from proceeding.

In the FOI response there were emails between the CVRD and the Ministry regarding KIP’s sewage application.

Received the following response to my email question if the CVRD made it clear to Melanie Mamoser that KIP’s application did not comply with the MDA.

Picture below taken a couple of days ago. Kip’s pipe is in the deepest part – notice how high the rocks are on the right. The creek has brought down a lot of rock over the winter and is more shallow.

Received the following email from a fellow landowner- name removed. Looks like the final decision to allow 1875 cubic meters of treated sewage to be dumped daily into Washer Creek will be made by the First Nations Bands mentioned in the email.

In addition to the K’omoks First Nation, we will be consulting with the Homalco, Qualicum, We Wai Kai and Wei Wai Kum First Nations to understand how their Aboriginal Interests may be affected by this application and seek to address their concerns.
