David Godfrey took a very active role in supporting KIP after the 2011 WIA expired Dec. 31, 2014. Meeting alongside the VP of KIP, Brian McMahon, with Minister Fassbender and getting the minister to appoint a facilitator claiming UBID was stalling KIP. That petition KIP representative David Godfrey obtained signatures for caused an uproar in the community with landowners believing the falsehoods spread by Godfrey, Jacques and Loxam and the developer. They were demanding an extension on that expired agreement.

…We had a perfectly good working agreement with them (UBID) that they purposely let expire without moving forward in a phased approach. It just became ridiculous.

What they didn’t do was find out if what they were proposing was legal. Turns out there couldn’t be an extension given, and UBID’s lawyers advised the board Dec. 2016, after they pushed through that very motion at their first meeting Nov. 13, 2016. KIP has been directing every board with the exception of the Molstad Board and when Ian Munro was chair guiding us through conversion to become a service area of the CVRD. Every other board was just a pawn to KIP.

They campaigned on dividing the community further by attempting to discredit the Molstad board because UBID wouldn’t give KIP an extension, when it was the Molstad Board who actually knew the expired agreement couldn’t be extended.

At the 2017 AGM, I asked Peter Jacques and Loxam if they sought legal advice to find out if the WIA could be legally extended before getting signatures on the petition. Jacques states he didn’t get any legal advice, it was his opinion that the WIA was still legal and in limbo. JFC.

McMahon, Godfrey, Jacques, Loxam and Bitten all claimed the WIA was still valid. So none of the upheaval was necessary, it only happened because McMahon and his ‘Respresentative’ and uninformed trustees created the problems in the community. JFC.

Jacques and Loxam were elected in April 2016 with proud McMahon sitting with them at the AGM. Within 2 months Jacques and Loxam had a secret meeting with McMahon and produced this letter to the board.

The end result was 3 trustees resigning due to Loxam and Jacques rogue actions. So from July 2016 to Oct. 2016, having only 2 trustees, the board was not functioning. A petition was circulated requesting we become a service area of the CVRD, but the Ministry insisted we have a by election. In October 2016, Susanna Kaljur, Jim Elliott and Rick Bitten were elected and joined the other two green trustees, Jacques and Loxam.

This inexperienced board at their very first meeting, Nov. 16, 2016, Loxam put forth a motion to extend the WIA that expired almost 2 years prior. This meeting went on for hours. Also, these incompetent trustees fired the professional negotiators because KIP knew he could manipulate these ignorant trustees just as he did when Godfrey, Royer, De Jersey gave KIP the 2011 WIA. All the upheaval in the community because a developer couldn’t accept his agreement had expired. He had lots of help in spreading lies throughout Union Bay. This developer is like a cancer on Union Bay and to have David Godfrey hold himself up as just a concerned landowner all the while assisting the developer in the division of the community is unforgivable. All any one of them had to do was find out if what they were telling the landowners was actually legally possible. They didn’t care about facts and were willing puppets to KIP at the expense to the community. They were incompetent and the damage is going to be felt for generations.

The board passed the motion to extend the agreement Nov. 13, 2016 and they received a response from UBID’s lawyer telling them they couldn’t. This is their mealy mouthed announcement. Three completely useless trustees believing the bullshit spewed by KIP and his representative.

If they had bothered, UBID had already been advised the WIA was dead by their legal counsel as well as the CVRD. The developer just wouldn’t accept that and got his representative to publicly claim the agreement COULD be extended and start a petition in 2015. It’s pretty clear where the blame lays for what has transpired since this cancer darkened our doorstep and infected a good number of landowners.
