The Union Bay Community Club Hall Double Standard and The Union Bay Improvement District Board’s First Kangaroo Court

NOTE:  President of the Union Bay Community Club Hall, Darcy Rainey, was present during the meeting.  The Community Club is fully aware of what transpired at the meeting disrupted by the pro Kensington Island Properties, but hey, they’re all friends, so there’s no problem.  This is Union Bay.

This meeting was held downstairs at the Union Bay Community Club Hall.  The same building the planned pro Kensington Island Properties candidates Rick Bitten (now trustee), Lone Jednorog and Ted Haraldson disruption took place.  At 5:40 you hear an objection to Chair Peter Jacques careless use of a legal definition of assault charge against a landowner.  You will note the three Trustees reactions including Rick Bitten who comments it’s a board meeting.  Does that mean Rick Bitten wants respect for those who have rented the Union Bay Community Club Hall?  What if another Union Bay Community Club member felt like coming in and taking control of the meeting – would that be okay by Rick Bitten?

This board has opened up a can of worms.  Some of the trustees believe they are role models and have the knowledge and wisdom to bring the community back together.  Now they have held their first mini kangaroo court.  When you put yourself on this pedestal, you better be squeaky clean.

What this new board offered landowners at their first meeting:

  • A chair who looks like he’s taking orders for who wants beer and burgers – lots of finger pointing.
  • A chair who never asks for a vote or motion
  • A chair who has no control over the meeting, trustees speaking whenever they want.
  • A chair who can’t take the heat and suddenly ends the meeting.
  • A chair who is going to have to be babysat by the Administrator because he doesn’t have a clue what he’s doing and has paid zero attention to how meetings have been conducted for the last 5 years.  It’s a gong show!
  • A chair who seems to believe his wanting to be chair is more important than having someone with the most experience so UBID can get up to speed faster.
  • An Administrator already doing all the work at UBID as his help is limited.  Now, five green trustees.
  • A board with three trustees who refuse to admit the clauses that cause concern in the 2011 expired WIA agreement exist.
  • A board that had a meeting after the meeting of the Committee of the Whole meeting.  This was not an in-camera meeting.  Our five elected Trustees held a meeting, obviously discussing Union Bay Improvement District issues.  Are there going to be minutes of this meeting?  There had better be.  This is a big no no for a board of trustees.  This is a red flag! Transparency????
  • A chair who now presides over Union Bay’s first official Kangaroo Court.
  • A chair who acts as prosecutor, judge and jury.
  • A chair who offers an official apology on behalf of the Union Bay Improvement District Board to his buddy protester Lone Jednorog who planned and executed the disruption of the All Candidates Meeting along with candidate Ted Haraldson and now trustee Rick Bitten at the Union Bay Community Club Hall where there are members.
  • A chair who makes a ridiculous statement at the 2:00 mark of the video “other and/or new business” asks if anyone has anything they want to bring forward.  The chair then states “Bearing in mind we can’t, ah we can’t conduct business.. whether there’s any, anything somebody wants to bring forward in the general sense.”  This is trustee Rick Bitten’s cue to show his ignorance of the position of trustee by offering an apology on behalf of UBID to his co-conspirator Lone Jednorog.
  • A chair who thinks it’s the board of trustees that puts on the elections and thinks the board has a vested interest and then can speak to guilt or innocence.  It is the Administrator – just like the election we just had.
  • A chair who is openly displaying his ignorance of the role of trustee and/or chair.
  • A chair and two trustees who are clueless about the limitations of their roles.

Union Bay Community Club Hall Rental – Be Aware of the Thugs

Over the last twenty years, I can’t count the number of times I’ve recommended the Union Bay Community Hall to people.  Beautiful building and grounds.

After what has transpired in the last few weeks, I will never recommend renting it again.  It appears like everything else in Union Bay, hillbilly rules have permeated the Union Bay Community Club.

The following video is from Oct. 19, 2016, at the Union Bay Community Club Hall, rented by a landowner who had advised all six candidates of the meeting and included rules they would have to abide by if they took part in the meeting.

The final 2 rules stated: 

  • Ground rules will be given to all candidates well in advance of tonight’s meeting
  • The chair will adjourn the meeting if the audience refuses to follow the rules and causes a major disruption to the proceedings.

Pro Kensington Island Properties candidate for Trustee of the Union Bay Improvement District Board AND a member of the Union Bay Community Club, Rick Bitten, on October 19, 2016, entered as a guest of the landowner who rented the hall.  Rick Bitten appears to be a member of the Union Bay Community Club.

At 1:36 in the video below, you can see me being pushed/shoved by an individual in a dark jacket – that is pro Kensington Island Properties candidate (now Trustee) Rick Bitten.

At l:58 in the video below, you can hear pro KIP candidate Rick Bitten as he’s leaving say ‘see ya, good meeting guys, perfect, shows what you really are’ and then says ‘you guys are mental’.

At the 4:32 mark in the video below, Rick Bitten states the actions by pro Kensington Island Properties candidate Lone Jednorog has nothing to do with the assault Bitten claims took place.

Are we to conclude then that if Rick Bitten or any other member of the Union Bay Community Club wishes to enter the Union Bay Community Hall when it has been rented, they are free to disrupt any event that has been planned?

Are we to conclude that we are not guaranteed the right to attend without fear of thugs disrupting the event or causing bodily harm?  Our community has many senior citizens.  Should senior citizens fear being bullied or charged if there is a repeat of the kind of incident involving pro Kensington Island Properties candidates Rick Bitten, Lone Jednorog and Ted Haraldson’s deplorable actions?

I have always believed when the hall and/or grounds are rented, landowners and residents acknowledge and respect the area is under the control of those who paid for the privilege.   Guess I was wrong.

Someone from the Union Bay Community Club needs to address these actions by one of their members.  Someone from the Community Club needs to make a public apology to the individual who had rented the Union Bay Community Club Hall, believing they would be free from harassment by anyone, including Union Bay Community Club members, to host their long planned event.

Union Bay Landowner Bruce Livesey’s Post-Election Comments

After helping to spearhead a team of candidates in Union Bay for Trustee positions on the Improvement District board, may I state the following facts?

Community candidates Jim Elliott and Susanna Kaljur easily defeated Ted Haraldson and Lone Jednorog. Although Cleve Goldswain never knocked on one door and didn’t publish any misleading or incorrect information he succumbed to Rick Bitten by only 2 votes. When no one else could be bothered to stand up for the community, Cleve took the challenge, THANK YOU.

Jim and Susanna will keep some sanity on the Board, however unfortunately there were no real winners because we still have the same polarized Board of years ago unless someone makes a change. As this was the dirtiest, slimiest most appalling campaign I have ever been involved in, this is not likely to occur. The 50% turnout was impressive but the other 50 need to show some interest, do not bury your heads in the sand; support your community.

Lastly, most of our meetings and decision making were made while walking and talking on the still contaminated coal site. However on October 25th my 67th birthday and only 3 days after the election, I received a very legal letter from 34083 Yukon Inc.{Kensington Island Properties} lawyers, banning me from any further walks on the sacred Kensington lands. I will be sued for damages punitive damages, an injunction and special costs. So if you see the ghost of Bruce Livesey walking there abouts, please report the occurrence to the Royal Canadian Mounted Police, they have been advised regarding this very sensitive matter.

Union Bay Improvement District Committee of the Whole – Hillbilly Union Bay

I’d like Rick Bitten to take note of what his role is as a Trustee.  It is not about healing the community – It is about making the right decisions in the best interest of the Union Bay Improvement District.  Water, Fire and Street Lighting.  Get it?

What I find so interesting about this ‘apology’ is that Rick is conveniently omitting his part in the disruption.  How about an apology to me for pushing me as Rick clearly does in the video below?

By offering this apology Rick is weasling out of any involvement in the planned disruption of the all candidates meeting.  Why didn’t Rick Bitton, Lone Jednorog and Ted Haraldson take their designated seats at the candidates table instead of bunching up at the entrance?  They had no intention of participating  in the meeting because they simply could not back up any of the verbal promises made by Brian Mcmahon.

Like I said – gutless.

Union Bay Improvement District Election – Police Required Due To Pro Kensington Island Properties Candidates Antics – Rick Bitten, Lone Jednorog and Ted Haraldson

Really have to give credit to Michael Briones of the Comox Valley Echo.  He is the only reporter in the valley who actually understands the complicated issues and is able to provide the facts accurately in his articles.  Unlike the Comox Valley Record who chooses to ignore the issues or just writes fluff pieces.
