Kensington Island Properties aka Union Bay Estates providing another yearly belly laugh!

Geez, I really laughed when I saw this. A fellow landowner received it in an email and wondered how they obtained their email address. How can anyone take this developer seriously after singing the same old song year after year? Promises, promises – all empty. Nothing can happen until subdivision – no application has been made to subdivide which triggers the Master Development Agreement.

I found it amusing that KIP used the photo of the road built by Wacor because I had asked who was paying for this project and received the following from the CVRD. West Fraser Mills.

The old marina story again. Geez, it took literally an hour and a half to find out this was bullshit.

Another landowner sent me their response from the CVRD today. Why spew this crap when it is so easily disputed?

Kensington Island Properties aka Union Bay Estates moving more soil around again – not in the phase one area for the 'Discovery Centre'. MDA still not triggered.

Nothing happened for weeks and now digging a big hole where soil was trucked in last year. This is normal for KIP. That’s all this developer has done, clear land and make a mess every time there is a claim of ‘moving ahead’.

Months have gone by with nothing happening in the Phase One area – lots of trenches and soil moved around.

So KIP wants to dump 1875 Cubic meters of treated sewage into Hart/Washer Creek daily from Oct. through May. This will be sewage from all of Union Bay and Royston. How can that be approved? The creek is very shallow – there is not a lot of water flowing.

Wastewater 

The CVRD received the following information from the Ministry of Environment and Climate Change:

“The Ministry of Environment and Climate Change received on November 11, 2019 a final application package from Kensington Union Bay Properties GP Limited for registration under the Municipal Wastewater Regulation for a seasonal discharge of up to 1,875 cubic meters per day of treated municipal sewage to Hart Creek during the months of October through May with storage and reclaimed water use during the rest of the year. The proposed discharge would serve a commercial and residential development in Union Bay subject of a Master Development Agreement with the Comox Valley Regional District. 

The Ministry’s next steps are a comprehensive review of the application for compliance with the Municipal Wastewater Regulation including review of the Environmental Impact Study, and First Nation consultation. There is no formal public consultation process for registrations under regulations such as the Municipal Wastewater Regulation. The review and decision phase takes up to 10 months to complete. Oh oh – big surprise – NOT. According to email “Development is stalled…” KIP/Union Bay Estates singing the same song.

Received this email circulated by the guy who brought you the petition that screwed up the 2015 Board’s plan to build water treatment facility by claiming KIP wasn’t being treated fairly. Their version of ‘fair’ was to force the 2015 UBID Board to extend the 2011 Water Infrastructure Agreement that KIP allowed to lapse Dec. 31, 2014. Here we sit under boil water advisory when we would have had the system by Aug. 2018 if these KIP flunkies hadn’t brought the process to a standstill getting people to sign stating they did not want to pay for the system.

This is also the same guy who told the landowners in 2011 that the WIA was a $1.7 Million dollar GIFT to the community and only admitted it was an interest free loan after Dec. 31, 2014! Look at the track record from this guy before you drink the KIP koolaid. Plus, this same guy has been referred to as “Kip’s Representative”.

The CVRD isn’t turning Union Bay into a third world country – the hillibillies have that locked up.

Note the last line: “With the Development stalled..” Oh gosh, who would have thought the development might not go ahead? It’s only been 24 years since KIP has been making outrageous promises only to have nothing happen. How could anyone be surprised?

Did these guys send an email to Arbour about the 1875 cubic meters of treated sewage planned to be dumped into Washer/Hart Creek daily if they are concerned about the shellfish industry?

Anyone buying a home in Union Bay is getting ripped off. Every couple of years this developer shows up and announces he’s going ahead and renames the development. The realtors latch on and spew the bullshit about a marina, hotels, blah blah and nothing ever happens and yet the prices continue to rise with nothing happening.

This is the bullshit McMahon spewed 2 years ago. Let’s get real. This guy isn’t going to build a sewage treatment plant. He’s going to sit and wait for the landowners to put up the bucks. When the South Sewer Project was active there was not a peep from this developer – never offered anything towards the system. What exactly has KIP done since 1996 when it was no longer Weldwood? Zip. Cleared land, dug trenches, dumped the 27 contaminated coal hill acres back on the province all the while patting the local hillbillies on the head telling them how smart they are.

“Everything is approved now. Before, we had ongoing hurdles we kept trying to overcome. Everything has improved,” he said. Next steps Before construction of any of the housing units can occur, Kensington will have to supply a wastewater treatment facility in order to service the projects. “We have to get the wastewater treatment plant up and running before we can sell any homes,” he said. “In order to do that, we need to get the pipes in the ground, we need to get roads built. We were meeting this morning talking about where the pipes are going to go.” McMahon said the company has applied to the Ministry of Environment to begin work on implementing a wastewater treatment facility. “That application is in the process,” he said. McMahon added the goal is to possibly begin construction on homes by summer 2019. “Before that, there will be roads, pipes put in the ground. There will be all the underground servicing going in,” he said.

Apparently, Arbour https://danielarbour.ca/contact/ can travel out of the country to receive an update on Union Bay Estates, but couldn’t be bothered to rent a room at the hall to meet with the landowners he represents. The only thing he could manage was a meeting at the market – how backwards and cowardly. Somehow he managed to meet with Fanny Bay residents at the OAP Hall and at the Royston Hall. How many people can fit into the market?

So Arbour is getting wooed by old slick. Guess slick sees the writing on the wall that his buddies on UBID are losing control and the dysfunctional form of government is not working for the landowners.

This trip is bs. It isn’t going to benefit anyone living in Union Bay and shows Arbour can be influenced and wined and dined by this sleazy developer, in my opinion.

  • Why would Arbour have to physically attend KIP’s lawyers office in Seattle for an update on a supposedly Canadian company project 15 km away?
  • Isn’t Arbour a pretty green Director?
  • What is his background that he will grasp what is presented?
  • What does he expect to learn from this trip that he couldn’t have learned right here where the project is and the VP of KIP?
  • Doesn’t our existing technology remove the need to physically attend in another country for an update?
  • Will KIP pull the old “you can view – but cannot have a copy”?

Received the following email from a fellow landowner- name removed. Looks like the final decision to allow 1875 cubic meters of treated sewage to be dumped daily into Washer Creek will be made by the First Nations Bands mentioned in the email.
