Now let’s see what happens with sewage. If KIP aka UBE needs it – then pay for it – not on the backs of existing landowners to ensure the development proceeds. This guy has been stalling for years and unless he puts up big bucks, there is no reason to believe anything promised.

Some background for those who don’t know. KIP signed the revised Master Development Agreement in Dec. 2017, with the CVRD, leaving the section regarding the developer building an expandable sewage system that Royston and Union Bay could hook into at their own cost. In Feb. 2018, KIP put in the application to dump treated sewage into Hart/Washer Creek, temporarily. So for 5 1/2 years Kip has been waiting for approval for the system exclusively for the development, all the while waiting for the existing landowners to fund a system to bring sewer south so that KIP could hook into.

The CVRD needs to honour and enforce the Master Development Agreement. This developer cannot be trusted to comply with anything their signature is put to. Look at the track record. KIP misled the CVRD when they gave the developer a deadline of April 30, 2017, “…to advise the CVRD how it intends to comply with the terms of its master development agreement..” and his lawyers responded on Apr. 28, 2017, that:

“…that KIP is of the view that it is currently in compliance with the master development agreement in all material respects.”

100% false. KIP violated the MDA 8 days earlier, Apr. 20, 2017, when KIP subdivided and dumped 27 contaminated coal hill acres back on the Province/you and me.

This mealy mouthed excuse:

…the fact the CVRD did not know about the transaction until after it occurred was an oversight and not done intentionally.

Bull. It wasn’t an oversight because ole slick has known for years there was a covenant on the entire development that the developer could not subdivide. That was bloody intentional, imo because ole slick couldn’t let the CVRD know he had violated the MDA. That’s why he can’t subdivide now – not until he fulfills the commitments the CVRD lists. Ole slick has known this since 2010!

This developer cannot be trusted. How many promises, assurances has this developer actually fulfilled? This bs stringing the community along has been going on for decades. Time for him to put up or shut up.
