‘Vanuatu must honour equal rights for all citizens’

Member of Parliament (MP) for Epi Constituency, Robert Bohn, a naturalised citizen, believes in a Vanuatu where all citizens, regardless of race, background, or origin, are valued equally and have the right to serve their communities if elected by the people.

MP Bohn made this statement in response to one of the policy directives in the government’s 100-day plan for political reform, which proposes that only indigenous Ni-Vanuatu people can contest provincial and legislative elections.

Mr. Bohn said Vanuatu is a proud signatory to several important international human rights agreements that protect the rights of all citizens, regardless of how they became citizens. Vanuatu has signed the Universal Declaration of Human Rights (UDHR), affirming equal rights for all citizens, and the International Covenant on Civil and Political Rights (ICCPR), ratified by Vanuatu in 2008. The ICCPR guarantees every citizen the right to participate in public affairs and hold public office without discrimination. Vanuatu also acceded to the International Convention on the Elimination of All Forms of Racial Discrimination (CERD) in 1980, which obligates governments to eliminate racial discrimination, especially in political and civil rights.

“Restricting public office only to indigenous citizens could be seen as discrimination based on origin — creating two classes of citizens and violating these agreements,” he added.

He further stated that this act could lead to a violation of Equal Rights and the Constitution itself. He cautioned that changing the Constitution to exclude naturalised citizens from standing for office would create a two-tier system of citizenship, where some citizens are more equal than others, which contradicts democratic values.

MP Bohn said the policy could undermine national unity and social harmony, disrespect the will of the people who elect their representatives, discredit Vanuatu on the international stage, and set a dangerous precedent.

The 100-day plan’s expected outcome for this electoral reform is to strengthen citizenship programme governance, enhance public trust in citizenship processes, preserve national identity, and strengthen cultural representation in governance. The focus will be on naturalised citizens, specifying that only third-generation citizens will be eligible to contest elections.

Leader of the Opposition, Alatoi Ishmael Kalsakau, recently said this policy could legitimise racism by the current government. He pointed out that the creators of the constitution intended for citizenship to be granted without discrimination as a precondition for independence.

Article 17 of the Constitution states that every citizen of Vanuatu who is at least 25 years old shall be eligible to stand for election to Parliament.

“The effect of this proposed amendment, which must undergo a referendum, could create a classification of citizens that divides society and legitimises racism,” said the Opposition Leader. 

He added that the government should address the more immediate problem of leaders failing to properly represent their constituents, which is the core issue. He also mentioned that some members of the current government may find themselves disqualified from contesting future elections.
