This is the perfect case to be heard under Protection of Public Participation Act. The pictures and videos do not lie. What has been happening at Deep Water Recovery Ship breaking should never have been allowed. Those who live nearby complained when they saw what was happening, were harassed by the owner Mark Jurisich, who banged on some of their doors and windows. DWR also sent cease and desist letters threatening legal action to those landowners demanding they remove images, criticisms, etc. This is in the public interest.
GEEZ – don’t know how I forgot to mention the Comox Valley Regional District’s lawsuit against Deep Water Recovery initiated in April 2022 for bylaw violations. Heard they have already had examinations and are waiting for a court date. Again, this is in the public interest.
It’s pretty obvious from the hundreds of drone videos the reason they objected so viciously to anyone recording and/or commenting on Deep Water Recovery operations – the videos document the business is not operating as promised and is an environmental disaster waiting to happen. That is in the public interest.
The beached asbestos laden Miller Freeman is a perfect example of every level of government failing Union Bay. None of them can claim they are unaware – all levels of government have been contacted and given access to the videos. This is in the public interest.
These documents are interesting reading. You’ll see the last paragraph on page 4 of the Counterclaim:
…conducted surveillance, recorded Deep Water Recovery’s business activities, operations, and employees on private property, and disseminated the images and recordings collected to third parties, without a claim of right or permission.
After Jason Gratl filed the PPPA application they tried to squirm their way out of their supposed outrage about ‘disseminating images and recordings to third parties’. They managed to delay and screw around for about six months and then they starting losing one application after the other.
Now, there is a 3 day hearing set for the PPPA application. Should be very interesting – as long as we don’t get bumped as we were in June 2023. Tick, tock.
