I’m not aware of that Gord. The last (third) opinion didn’t specify the reason – indicating “the force majeure clause cannot be invoked unilaterally by UBID nor has a claim of force majeure been established”

Maybe my memory fails me but didn’t UBID’s lawyer advise that the remediation had per se nothing to do with the proposed water system so the remediation could not be used to invoke the Force Majure clause?
